We are “Publica” and are a council owned employment company which delivers shared services between Cotswold, West Oxfordshire, and Forest of Dean District Councils and Cheltenham Borough Council (hereon known as “Clients”). Publica additionally provides services to the Cheltenham Trust, Cheltenham Borough Homes and Ubico (an environmental services local authority company).

Who we are and what we do

Publica Group (Support) Limited is a council owned employment company which delivers shared services between Cotswold, West Oxfordshire, and Forest of Dean District Councils and Cheltenham Borough Council (hereon known as “Clients”). Publica additionally provides services to the Cheltenham Trust, Cheltenham Borough Homes, Cheltenham Leisure & Culture, Cotswold National Landscape and Ubico (an environmental services local authority company) (hereon known as “Clients”).

Publica’s Accountancy & Finance section provides a range of financial services to the partner councils and external clients including financial planning, statements of accounts, budgeting, financial systems and controls, payments and strategic payroll.

Publica is a data controller and data processor under the Data Protection Legislation; we collect and process personal information about you in order to provide these services, and to meet our statutory and regulatory obligations.

This notice explains why we ask for your personal information, how that information will be used and how you can access your records.

Why we need your information and how we use it

Publica’s Accountancy & Finance section holds information about individuals so that it can carry out effective financial management including the list is not exhaustive:

  • processing payments to external individuals
  • processing payments to employees and elected councillors
  • recording transactions on the ledger
  • properly accounting for expenditure and income
  • budget setting and budget monitoring
  • providing financial management information
  • costing staffing budgets
  • providing financial analysis and advice to internal and external customers
  • management of corporate and accounts
  • submission of government grant funding claims
  • administration of employee car loans and leases

We also have a statutory and regulatory obligation to provide these services in accordance with the following legislations, the list is not exhaustive:

  • On behalf of each partner council: the Section 151 of the Local Government Act 1972 requires local authorities to make arrangements for the proper administration of their financial affairs
  • On behalf of each partner council: The CIPFA Statement on the role of the Chief Financial Officer (CFO) in local government describes the role and responsibilities of the CFO including responsibility for the finance function
  • On behalf of each partner council: the CFO and the Accountancy & Finance service require to access individuals’ information as required in order to carry out the role
  • The Local Government Finance Act 1988 (Rates)
  • The Local Government Finance Act 1992 (Council Tax)
  • Localism Act 2011

What type of information is collected from you

Publica’s Accountancy & Finance section collects and processes the following types of personal data in order to provide the services:

  • personal, for example: name, address, telephone, date of birth (Where a supplier is a sole trader the business address details will potentially be the individual’s personal data. It is noted that where this crossover occurs the individual’s personal data will be provided full data protection and will not be used for purposes outside those of the related business entity)
  • employee information, for example, payroll number, salary, taxation, national insurance, pension details, sickness details
  • bank account details
  • email addresses
  • private vehicle details
  • personal details relating to insurance claims
  • Insurance related legal records.

We will only ask for personal information that is appropriate to enable us to deliver our services. In some cases, you can refuse to provide your details if you deem a request to be inappropriate. However, you should note that this may impact on our ability to provide some services to you.

Who your information may be shared with (internally and externally)

Publica’s Accountancy & Finance section procures systems from various suppliers to support its financial management role. The following providers may have access to your information purely for the purposes of supporting our systems; they will not use your information for any other purpose:

  • Unit 4 (Agresso Business World)
  • Civica Payments

Publica’s Accountancy & Finance section may share or disclose your information to any of the following recipients as may be necessary for the financial administration of the authority in line with statutory obligations and/or to comply with contractual obligations relating to it:

  • service providers, professional advisers and auditors who in certain circumstances will also be “data controllers”
  • regulators, the government, local and foreign law enforcement authorities
  • His Majesty’s Revenue and Customs
  • local and foreign courts, tribunals and arbitrators, other judicial committees of enactments of laws
  • past and present insurance providers, brokers and claims handlers.

How long we keep your information (retention period)

Data is only held as long as is necessary, unless superseded by statutory regulation, and disposed of securely when it is no longer needed.

How we protect your information

Your data is stored securely on Publica’s systems and accessed only by authorised officers using their own username and password created in line with pre-defined user credentials. Personal data is also held in electronic files on Publica’s network drives. These are only accessible through personal logon credentials and access privileges to specific drives. Access to our sites require a personal electronic pass to access staff only areas. Publica has strict procedures for the way this is done. Any and all information about you is treated as confidential and with respect. There are also clear rules and guidance about storing, recording and sharing information which staff receive training on.

We will not transfer your personal data outside the EU without your consent.

We have implemented generally accepted standards of technology and operational security in order to protect personal data from loss, misuse, or unauthorised alteration or destruction.

Please note however that where you are transmitting information to us over the internet this can never be guaranteed to be 100% secure.  

For any payments which we take from you online we will use a recognised online secure payment system.

We will notify you promptly in the event of any breach of your personal data which might expose you to serious risk.

Your rights 

You have rights under the Data Protection Legislations:

  • to access your personal data
  • to be provided with information about how your personal data is processed
  • to have your personal data corrected
  • to have your personal data erased in certain circumstances
  • to object to or restrict how your personal data is processed
  • to have your personal data transferred to yourself or to another business in certain circumstances
  • you have the right to be told if we have made a mistake whilst processing your data and we will self report breaches to the Commissioner.

The Data Protection law gives you the right to apply for a copy of information about yourself. This is called a ‘Subject Access Request'.

If you wish to see a copy of your records you should contact the Data Protection Officer. You are entitled to receive a copy of your records free of charge, within a month.

In certain circumstances access to your records may be limited, for example, if the records you have asked for contain information relating to another person.

The accuracy of your information is important to us to be able to provide relevant services more quickly. Publica is working to make our record keeping more efficient. Why Publica needs your information and how we use it

How we communicate with our Clients’ residents and third parties is really important to us. We are always working to let Clients’ residents and third parties know about what we are doing for local communities, provide updates on vital services and help you better understand how we operate and the decisions we take.

The Communications team processes personal data to enable to team to prepare communications and deal with media requests. The team does not routinely collect special category personal data.

We collect this information by:

  • telephone, email, social media, writing or in person
  • Electronic sign up forms such as e-bulletin subscriptions

What is the legal process for collecting and processing this data

Under the UK General Data Protection Regulation (GDPR) and Data Protection Act 2018, the lawful bases we rely on for processing this information are;

  • Your consent. This is required if you appear in photographs or videos used for promotional or media coverage or if you subscribe to receive direct marketing from us e.g. newsletters. Consent only relates to the specific purpose for which it has been given and you can withdraw your consent at any time. We do not rely on consent as a legal basis for any other processing.
  • We need it to perform a public task Article 6(1)(e). To fulfil the duty to inform and engage with Clients’ residents and other partners.

What type of information is collected from you

Personal details, which may include:

  • Name
  • Address
  • Other contact details – email address and telephone number
  • Parental consent and contact details for entrants aged 18 or younger

Others include:

  • Video footage
  • Photographs
  • Films or words

Special categories of personal data

We will not purposely collect any special category or criminal data. Photographs or videos may collect special category data including:

  • personal data revealing racial or ethnic origin
  • personal data revealing political opinions
  • personal data revealing religious or philosophical beliefs
  • data concerning health

Who your information may be shared with (internally and externally)

Your data is shared internally only with the appropriate staff where it is necessary for the performance of their roles.

We may also receive your personal information indirectly for PR or marketing purposes from our Clients and other organisations (e.g. Emergency Services, Landlord, Housing Associations, third sector partners) regarding an individual.

Your data may be shared externally with organisations for media publicity and via emailed press releases to organisations. You will also be asked if you consent to this beforehand.

Apart from where previously stated, we do not pass your details to third parties without your consent or unless we are lawfully required do so.

How long we keep your information (retention period)

We will only retain your personal information for as long as we are required to do so by law and the purpose, we collected it for.

The retention period is either dictated by law or by our discretion. Once your data is no longer needed it will be securely and confidentially destroyed or dispose of the data in line with retention schedules.

  • Photos/Video footage – three years
  • E-forms – one year

  • If you are making a general enquiry to Publica, we will rely upon your consent to process your personal data under Article 6(1)(a) of the UK General Data Protection Regulation.
  • If you are raising a safeguarding concern, we rely upon the lawful condition for processing outlined in Article 6(1)(c) of the UK General Data Protection Regulation (processing is necessary for compliance with a legal obligation to which the controller is subject).

What type of information is collected from you

We may collect and store records about you on our secure Customer Relationship Management   system, which may include:

  • Personal information including: name, contact details, personal finance information, personal identification and payment details dependent on the service or response required.
  • Recordings of telephone discussions you have with the Customer Service Centre;
  • Information you provide us on forms, in emails or via telephone discussions;
  • Information you provide us in email correspondence regarding complaints, queries or issues you are experiencing.

We will only ask for personal information that is appropriate to enable us to deliver our services.

In some cases, you can refuse to provide your details if you deem a request to be inappropriate. However, you should note that this may impact on our ability to provide some services to you.

To deliver services to you it may be necessary to share your personal data with other services and partner organisations. We may also share information to enable us to comply with court orders and other legal obligations. If this is necessary, we will only share the minimum amount of personal data needed for this purpose.

Please note that we will always endeavour to share only the minimum amount of personal data that is necessary for the intended purposes.

Data protection principles

The Act contains six data protection principles with an overarching accountability responsibility for data controllers to demonstrate compliance with these principles. This means personal data must be processed:

  • Lawfully, fairly and transparently
  • For specified, explicit and legitimate purposes and not processed in a manner other than the purpose it was collected
  • Adequate, relevant and not excessive
  • Accurate and where necessary kept up to date
  • Not kept longer than necessary
  • With the appropriate security and protection

Personal data shall not be transferred to countries that do not have an adequate level of data protection.

Reporting personal data breaches

Data breaches are defined as a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data. This means that a data breach is more than just losing personal data.

You must report data breaches to Publica’s Data Protection Officer (DPO) as soon as you become aware of them by emailing data.protection@publicagroup.uk.

There is a strict requirement on us to notify reportable breaches to the Information Commissioner’s Office (ICO) without undue delay and within 72 hours. The clock starts ticking for our Data Protection Officer to make a report to the Information Commissioner’s Office as soon as we become aware of the data breach.

Delays in reporting breaches or suspected data breaches to Publica means that there is less time to investigate these matters and take appropriate action to mitigate any harms which may be caused to the individuals affected.

Please ensure that any data breaches reported include an accurate summary of the personal data involved and the number of people affected.

Data breaches can have a significant detrimental impact on individuals and organisations, so please do all you can to enable us to respond efficiently and well within the reporting requirements.

Data protection individual’s rights and subject access request

All processing of personal data must be in accordance with the data subject's rights. These include:

  • The right to be informed
  • The right of access
  • The right to rectification
  • The right to be forgotten
  • The right to restrict processing
  • The right to data portability
  • The right to object
  • The rights in relation to automatic decision making and profiling
  • The right to lodge a complaint with the supervisory authority

Subject access and rights requests

Under data protection legislation an individual has the right to access the information that an organisation holds about them. Accessing personal data in this way is known as making a subject access request.

Subject access requests are different to requests submitted under FOI legislation, which relate to information about the organisation itself.

You are entitled:

  • to be informed whether your personal data are being processed
  • to be sent a copy of your personal data subject to any applicable exemptions and the removal of other people's personal data as appropriate

Your request to Publica may be submitted in whatever format you wish, but we have created a standard subject access and right request form for your convenience, which may be completed and emailed to data.protection@publicagroup.uk.  

Using the form will help us to verify your identity and give a timely and accurate response to your request. There is no charge to make a subject access request.

Retention schedule

Publica’s Data Retention Policy sets out a list of records for which pre-determined retention dates have been established. The retention schedule brings together the following information:

  • The name and purpose for processing of Publica's data processing activities; 
  • disposal, pseudonymisation or anonymisation of those records which have completed their retention period;
  • storage of records which have to be kept after their retention period insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes.

Personal information requests – police and other agencies

In some circumstances, the police and other authorised agencies can request access to personal information held by Publica for specified purposes. These types of requests may be permitted if an exemption under Schedule 2 Part 1 of the Data Protection Act 2018 applies. 

The Data Protection Act does not give an automatic right of access to information, however, it does allow Publica to assess the merits of requests and decide whether or not to apply an exemption.

Why we need your information and how we use it

We use drone footage to capture images of council owned facilities for promotional purposes. The team will also capture other images of the district to promote the councils generally, and local services. Landowner permission where necessary will be obtained at all times.

In the vast majority of occasions, and as a standard practice, any images of people or vehicles that would be in breach of data protection laws will be obscured in our final edit before publication.

We do not sell your personal information to anyone else.

What is the legal process for collecting and processing this data

Under the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018, the lawful bases we rely on for processing this information are:

  • UK GDPR Article 6 (1) (a) Consent – consent has been given by the data subject, yourself, for the lawful processing of your personal data.

What type of information is collected and how will we use it?

We use drone footage to capture images of council owned facilities for promotional purposes. The images will be used on promotional channels such as social media and websites.

We do not collect or store any personal information such as names, contact details or addresses - only images.

Who your information may be shared with (internally and externally)

All information/footage will be used for promotional material on our social media platforms, e-newsletters, websites and printed materials, across our services and in partnership with third parties for marketing campaigns.

Any personal information protected by law will not be disclosed to any other organisations, except where we are required and allowed to by law, to safeguard public safety and in risk of harm or emergency situations.

How long do we keep your information (retention period)

Why Publica needs your information and how Publica uses it

Our Communications and Marketing Team is responsible for the promotion of services, campaigns and events in order to provide information, encourage take up, change behaviours and enhance the reputation of Publica. We use social media as part of this role. Photography and filming form an important part of this role.

Publica does not sell your personal information to anyone else.

The communications and marketing team uses your information for the following:

  • Press and media (including newspapers, magazines, websites and social media)
  • On our website and our partner’s websites
  • On our social media feeds including Twitter, Facebook, YouTube, Instagram and LinkedIn
  • In our printed publications such as the Cotswold Newsletter
  • In printed publicity literature such as leaflets, posters or other display materials.
  • We use images to promote services across Publica, the partner councils and our other business partners.
  • The images/footage will often be accompanied by the details of the story you, your child / dependent is helping to promote. When known, e.g. at an organised press event, this could be the full name, age, the area, school or club / organisation the event / activity is taking place in.
  • We will only use images/footage that are appropriate.
  • We will not publish images / footage which could imply criticism or damage a person’s reputation.
  • We will not film or take photographs of any child that is considered at risk or under a supervision order.
  • We will use your image/footage to promote the service/s or events at which they were taken and for wider related service / event promotion. For example a photograph taken of children for a litter-picking campaign may also be used to promote our broader clean and green service.
  • If we want to use your image for larger publicity purposes, we will discuss this with you separately. For example if we wish to use your image on a bus, a billboard, or a suite of campaign posters and leaflets.

What is the legal process for collecting and processing this data

The lawful basis for processing your information are:

  • GDPR Article 6(1)(a) - the data subject has given consent to the processing of his or her personal data for one or more specific purposes.
  • GDPR Article 6(1)(f) Legitimate interest - Legitimate interest: processing is necessary for the purposes of the legitimate interests (we can use ‘legitimate interests’ if we can demonstrate that the processing is for purposes other than for performing our tasks as a public authority). In this context, we aim to provide a rich and varied quality of life for the benefit of our communities, by increasing the opportunities for participation by the public, in cultural and leisure activities in the districts (Cotswold, Forest of Dean and West Oxfordshire), and participation in campaigns and service initiatives.

Key partners will be identified on the promotional material related to a campaign or event.

How long Publica keeps your information (retention period)

Publica has a corporate retention policy in place to ensure that information is only held for as long as it is needed. The Communications and Marketing Team will keep your personal information for three years and may use images/ footage in council publicity for up to three years from the date the pictures were taken.

Publica will not keep your information for longer than is required to by law. Your information will be disposed of in a controlled and secure manner in accordance with Publica’s policy.

Why we need your information and how we use it

Publica needs to process data to enter into an employment contract with you and to meet its obligations under your employment contract. For example, it needs to process your data to provide you with an employment contract, to pay you in accordance with your employment contract and to administer, pension and benefit entitlements.

In some cases, Publica needs to process data to ensure that it is complying with its legal obligations. For example, it is required to check an employee's entitlement to work in the UK, to deduct tax, to comply with health and safety laws, to enable employees to take periods of leave to which they are entitled, and to consult with employee representatives if redundancies are proposed or a business transfer is to take place.

For certain positions, it is necessary to carry out criminal records checks to ensure that individuals are permitted to undertake the role in question. We will carry out checks every 3 years after commencement of employment.

Processing employee data allows the organisation to:

  • run recruitment and promotion processes;
  • maintain accurate and up-to-date employment records and contact details (including details of who to contact in the event of an emergency), and records of employee contractual and statutory rights;
  • operate and keep a record of disciplinary and grievance processes, to ensure acceptable conduct within the workplace;
  • operate and keep a record of employee performance and related processes, to plan for career development, and for succession planning and workforce management purposes;
  • operate and keep a record of absence and absence management procedures, to allow effective workforce management and ensure that employees are receiving the pay or other benefits to which they are entitled;
  • obtain occupational health advice, to ensure that it complies with duties in relation to individuals with disabilities, meet its obligations under health and safety law, and ensure that employees are receiving the pay or other benefits to which they are entitled;
  • operate and keep a record of other types of leave (including maternity, paternity, adoption, parental and shared parental leave), to allow effective workforce management, to ensure that the organisation complies with duties in relation to leave entitlement, and to ensure that employees are receiving the pay or other benefits to which they are entitled;
  • ensure effective general HR and business administration;
  • conduct employee engagement
  • provide references on request for current or former employees;
  • respond to and defend against legal claims; and
  • maintain and promote equality in the workplace.

Where Publica relies on legitimate interests as a reason for processing data, it has considered whether or not those interests are overridden by the rights and freedoms of employees or workers.

Some special categories of personal data, such as information about health or medical conditions, is processed to carry out employment law obligations (such as those in relation to employees with disabilities and for health and safety purposes). Information about trade union membership is processed to allow the organisation to deduct union subscriptions.

Where the organisation processes other special categories of personal data, such as information about ethnic origin, sexual orientation, health or religion or belief, this is done for the purposes of equal opportunities monitoring.

Data that the organisation uses for these purposes is anonymised or is collected with the express consent of employees, which can be withdrawn at any time.

Employees are entirely free to decide whether or not to provide such data and there are no consequences of failing to do so.

What is the legal process for collecting and processing this data

We rely on a number of lawful bases for processing personal data. Primarily, our lawful basis is for the performance of the contract between us but in some cases we will process personal data where we are under a legal obligation to do so.

We also rely on legitimate interests in processing personal data (for example where we need to keep a record of employee performance, keep a record of grievance or disciplinary process, records of training, issuing ID cards and monitoring of systems or respond to or defend legal claims).

What type of information is collected from you

Publica collects and processes a range of information about you. This includes:

  • the terms and conditions of your employment;
  • details of your qualifications, education, skills, experience and employment history, including start and end dates, with previous employers and with the organisation;

  • information about your marital status, next of kin, dependants and emergency contacts;
  • information about your nationality and entitlement to work in the UK;
  • information about your criminal record;
  • details of your schedule (days of work and working hours) and attendance at work;
  • details of periods of leave taken by you, including holiday, sickness absence, family leave, and the reasons for the leave;
  • details of any disciplinary or grievance procedures in which you have been involved, including any warnings issued to you and related correspondence;
  • assessments of your performance, including my performance conversations (where appropriate), training you have participated in, performance improvement plans (where appropriate) and related correspondence;

  • details of trade union membership for payment deductions; and

Publica collects this information in a variety of ways. For example, data is collected through application forms, CVs or resumes; obtained from your passport or other identity documents such as your driving licence; from forms completed by you at the start of or during employment (such as benefit nomination forms); from correspondence with you; or through interviews, meetings or other assessments.

In some cases, the organisation collects personal data about you from third parties, such as references supplied by former employers, information from employment background check providers, information from credit reference agencies and information from criminal records checks permitted by law.

Data is stored in a range of different places, including in your personnel file, in the organisation's HR management systems and in other IT systems including the organisation's email system.

Who your information may be shared with (internally and externally)

Your information will be shared internally with:

  • members of the HR team (including payroll)
  • your line manager
  • managers in the business area in which you work
  • IT staff if access to the data is necessary for performance of their roles.

Your data may also be shared with:

  • employee representatives in the context of collective consultation on a redundancy

This would be limited to the information needed for the purposes of consultation, such as your name, contact details, role and length of service.

Publica shares your data with third parties in order to:

  • obtain pre-employment references from other employers
  • obtain employment background checks from third-party providers
  • obtain necessary criminal records checks from the Disclosure and Barring Service

Publica also shares your data with third parties that process data on its behalf, in connection with:

  • payroll
  • the provision of benefits
  • the provision of occupational health services
  • the provision of pension services

Under the Local Government Act 1972 Section 117, a legal duty is imposed on all officers to make a disclosure of interests that are disclosable.

Automated decision-making

Employment decisions are not based on automated decision-making.

How long we keep your information (retention period)

If you are applying for a role and are unsuccessful, we will keep your data for 12 months, after which time it will be destroyed. If you decide that your data is to be removed from the system please email HR@publicagroup.uk.

Any and all information about you is treated as confidential and with respect. There are also clear rules and guidance about storing, recording and sharing information which staff receive training on.

Under Section 151 of the Local Government Act 1972 we are required to hold or have access to information from systems and processes across the Clients. Access to this information is securely provided to SWAP in order to fulfil the legal requirement to provide an internal audit function and to prevent, detect and deter fraud and / or corruption, thus safeguarding the public purse and providing assurance of safe stewardship of public funds.

What is the legal process for collecting and processing this data

    • b) supply such information and explanation.

Why Publica needs your information and how we use it

Publica holds information about you in order to enable it to provide services and to meet its statutory and regulatory obligations, a subject access request enables you as the data subject to request a copy of this information.

As part of the subject access request process we will require further information to ensure the validity of your request. In this way we can ensure that we are able to respond to your request and that any information provided is sent to those who are legally entitled to receive it. If you chose not to provide some of this information we may not be able to progress with your request.

  • Confirmation of identity (current, valid photo-card driving licence or birth/adoption certificate or passport) and proof of address (utility bill or bank statement less than 3 month old).

This is to ensure that you are legally entitled to receive the information requested.

We will not purposely collect any special category or criminal data.

Your data is shared internally only with the appropriate staff where it is necessary for the performance of their roles in processing your request.

Data may be shared with a third party acting on your behalf e.g. legal representative appointed by yourself.

We will not normally share your information with organisations without your consent, however, there may be certain circumstances where we would share without consent such as where we are required to do so by law e.g. emergency situations.

How long Publica keeps your information (retention period)

We will retain the personal information collected as part of the subject access request process for 3 years from the date of completion of the request.

Your ID and proof of address will be deleted one month after the SAR has been completed.

Once your data is no longer needed it will be securely and confidentially destroyed or disposed of in line with retention schedules.

Personal data is also held in electronic files on our network drives. These are only accessible through personal logon credentials and access privileges to specific drives. Any and all information about you is treated as confidential and with respect. There are also clear rules and guidance about storing, recording and sharing information which staff receive training on.
